The Delaware court has denied to a Worldwide Automaker Ford’s Mesothelioma verdict. The Global Automakers Ford were bidding for an overturn of $9.1 Million.
A few months ago, a widow of an Auto Mechanic along with a local automotive businessman filed a lawsuit against the company.
The attorneys on the widow’s side are claiming Ford Motors for being the reason for her husband’s death.
The widow’s attorneys stated that her husband worked with the company as an auto mechanic for a very long time. This led to continuous exposure to asbestos.
This later resulted in the death of her husband.
The attorney argued that the products used by Ford Motors are basically asbestos-contaminated products. This is the reason for the worker’s death.
The Widow filed the lawsuit back in June 2018. In the courthouse, the jury took the case in favor of the widow’s attorney. In the verdict, Ford Motors was found 20% responsible for the mechanic’s death.
The Widow won the verdict and is awarded over $40 Million. The overall compensation included normal damages, as well as advanced damages too.
The jury filed two motions to the Ford Motors. The first one included a request on the verdict to overturn the case be heard again on the basis of law.
While the second one included the agreement of a new case about the amount of compensation. It can be reconsidered as excessive on the basis of assertion.
Later, the high court of Delaware rejected both the motions. This resulted in the Auto Company Ford Motors in a $9.1 Million verdict.
Mesothelioma & Asbestos in the Automotive Industry
The United States Department of Labor, Occupational Safety and Health Administration (OSHA) states the presence of asbestos in the Automotive Industry.
They clearly state that in the manufacture of new brakes and several clutches, there is no presence of asbestos.
But in the manufacture of many mechanics and automotive repair products, there is a possibility for the presence of asbestos in it.
There is also a probability for the presence of asbestos in old brakes and clutches.
It is very clear that if someone is exposed to asbestos, there is a mere chance of Mesothelioma, Lungs Cancer and asbestosis.
The identifications are not identified instantly and can take several decades to show up.
In order to reduce the chances of Asbestos exposure and Mesothelioma Cancer, the United States Department of Labor, Occupational Safety and Health Administration (OSHA) along with US Environmental Protection Agency (EPA) recommend not to use Asbestos related material in the automobile industry.
And if you are supposed to use asbestos-contaminated products, you should hire professional mechanics. Those mechanics should have informed about the presence of asbestos and have proper knowledge about the outcomes of asbestos exposure.
If you have ever been exposed to asbestos; whether at your workplace or at your home, you must tell your doctor about it. Even if you are confused about the exposure of asbestos, you should visit your doctor ASAP.
You should keep in mind that mesothelioma symptoms take several decades to show up. And once it reaches a higher stage, it is close to incurable.
Thus, we highly recommend you to visit your doctor if any minor symptoms show up in your body. Because if the symptoms are identified in the early stage, it becomes easier to get proper treatment and perfect diagnosis.
Yes, it is true that Mesothelioma has no cure till date. But, your life can be saved if the symptoms are identified in the early stage. Trust me your doctor can help you monitor the symptoms and will recommend the perfect treatment.
So, if you feel a little bit risky, make sure to visit your Doctor as soon as possible.
